We collect the following categories of personal information:

  • Contact details: name, email address, telephone number, and any other details you provide through the Website contact form

  • Commission enquiry information: project details, material preferences, dimensions, budget indications, and any other information you include in an enquiry

  • Newsletter and mailing list data: email address and name, where you subscribe to receive updates from Will Marx

  • Payment and transaction data: where an online store is introduced in future, payment information will be collected. This policy will be updated at that time to reflect the specific payment processor used and the categories of data collected. No payment data is currently collected through the Website

  • Technical data: IP address, browser type, device type, pages visited, time on site, and referral source, collected automatically through analytics tools once these are enabled. Analytics are not currently active on this Website

Our newsletter will be managed through Mailchimp (Intuit Inc.), or an equivalent platform. Where Mailchimp is used, your subscription data is stored and processed in the United States. We will not add you to any mailing list without your prior consent.

The Website is built on and hosted by Squarespace. Squarespace may set cookies on your device to support the Website's operation. These may include essential cookies required for the Website to function, and analytical cookies to understand visitor behaviour.

We intend to enable Google Analytics on this Website in future to support an advertising campaign. When Google Analytics is activated, this policy will be updated to reflect the specific categories of data collected and to provide opt-out mechanisms. Google Analytics is not currently active on this Website.

No payment data is collected through the Website at this time. All commission deposits, payments, and financial arrangements are currently handled entirely offline by direct agreement.

9. Cross-Border Data Transfers

The Website is hosted by Squarespace Inc. in the United States. Personal information submitted through the Website may be transferred to and stored on servers in the United States.

For EU and UK visitors, Squarespace relies on Standard Contractual Clauses for transfers of personal data from the EU and UK. Mailchimp similarly relies on Standard Contractual Clauses for international transfers.

10. Security

We take reasonable steps to protect personal information from misuse, loss, unauthorised access, modification, and disclosure. The Website uses HTTPS encryption for data in transit.

In the event of a data breach likely to result in serious harm, Will Marx will comply with the Notifiable Data Breaches (NDB) scheme under the Privacy Act 1988 (Cth), and will notify the Office of the Australian Information Commissioner (OAIC) and affected individuals as required. For EU and UK breaches, we will notify the relevant supervisory authority within 72 hours as required by the GDPR and UK GDPR.

11. Retention of Personal Information

  • Commission enquiries that do not proceed: retained for three years from receipt, then securely deleted

  • Records relating to completed commissions: retained for seven years to meet tax and business record-keeping obligations

  • Newsletter subscription data: retained until you unsubscribe or request deletion

  • Analytics data: retained in accordance with Google Analytics retention settings, once enabled
